By Brazil Stock Guide – Brazil’s federal government has formally suspended preparations for the Tecon 10 container terminal auction at the Port of Santos, signaling a broader review of the project’s structure amid regulatory and legal concerns.
The Ministry of Ports and Airports notified the National Waterway Transportation Agency (ANTAQ), stating that new guidelines for the concession model are under discussion with the presidential Chief of Staff’s office. The move reflects an effort to refine the project framework and align it with public interest considerations.
In the official communication, the ministry said “new directives and parameters related to the leasing of the Tecon Santos 10 area are under discussion, with the aim of improving the model and enhancing service delivery in the port sector.” The government cited administrative caution, governance standards and decision-making security as key factors behind the pause.
The original model proposed by ANTAQ included restrictions on existing container terminal operators in the initial bidding phase. During its review late last year, Brazil’s Federal Court of Accounts (TCU) recommended extending those limits to shipping companies, effectively barring vessel owners from participating.
The ministry had previously asked ANTAQ in January to revise the auction structure to incorporate the TCU’s guidance, with an initial timeline targeting March. However, the proposal remained under internal debate, particularly after the Chief of Staff’s office called for a reassessment of the terms.
Former Ports Minister Silvio Costa Filho had already indicated a delay before leaving office, pushing the expected auction window to the second half of the year, between October and November. He highlighted restrictions on shipping companies as a central issue in the discussions.
