Cade Upholds Block on WhatsApp AI Restrictions in Brazil

Brazil’s antitrust court keeps suspension of new WhatsApp Business terms that would have barred AI developers from the platform ecosystem.

By Brazil Stock Guide – Brazil’s antitrust tribunal has upheld a preventive measure blocking new WhatsApp Business terms that would restrict artificial intelligence developers, in a decision that underscores growing scrutiny of Big Tech platforms and their control over digital ecosystems. The Tribunal of the Administrative Council for Economic Defense (Cade) unanimously rejected an appeal by WhatsApp and Facebook Brasil, maintaining an order that suspends rules designed to prohibit AI providers and developers from accessing or using the messaging platform’s ecosystem.

The dispute began in October 2025, when WhatsApp announced that new terms scheduled to take effect on Jan. 15, 2026 would prevent third-party AI services from operating within its messaging environment. Brazilian AI startups Luzia and Zapia subsequently filed a complaint with Cade, arguing that the change could effectively close the domestic market for AI tools designed to operate within messaging apps — a critical distribution channel in Brazil, where WhatsApp is used by the vast majority of internet users and plays a central role in commerce and customer service.

In January 2026, Cade’s General Superintendence opened an administrative investigation and issued a preventive order suspending the new terms. The agency said the restrictions could limit competition by preventing independent AI developers from integrating their tools with the platform.

When reviewing the appeal, the tribunal concluded that the conditions required to maintain the preventive measure remained in place. According to the case’s reporting commissioner, counselor Carlos Jacques, there are credible legal indications that WhatsApp’s position in Brazil’s messaging market could allow the company to impose rules that restrict competition. The judges also determined that a blanket exclusion of third-party AI tools would likely be disproportionate.

AI Meets Platform Power

The ruling highlights the growing intersection between generative AI and platform regulation. Messaging platforms increasingly serve as gateways through which AI assistants, chatbots and automation services interact with users. Restricting access to such ecosystems could effectively determine which technologies reach consumers.

Cade’s tribunal said allowing the new terms to take effect could prevent AI solutions from operating in Brazil’s messaging market and create a risk of competitive harm. At the same time, maintaining the preventive measure merely preserves the status quo that existed before the policy change and does not impose immediate damage on WhatsApp or its parent company.

The case also places Brazil within a broader global debate about the power of digital platforms. Cade noted that the decision aligns with scrutiny underway in other jurisdictions, including investigations by Italy’s Autorità Garante della Concorrenza e del Mercato and ongoing inquiries at the European Commission into platform restrictions affecting AI developers.
