By Brazil Stock Guide – Brazil’s power regulator Aneel postponed on Tuesday (Nov. 4) a decision that could lead to the termination of Enel São Paulo’s distribution concession, following a request for review by board member Gentil Nogueira. The case examines whether the Italian-controlled utility (ENEL.MI) has improved its response to extreme weather events that left millions of customers in the dark across 24 cities, including the state capital.
The Valor Econômico newspaper reported that director Agnes da Costa, who leads the proceeding, voted to extend oversight of the company’s performance until March 2026, when the rainy season will have provided another full test of Enel’s recovery plan. “We must ensure that corrective measures deliver consistent results under harsher conditions,” she said.
Technical staff told the board that Enel’s response times and long-duration outage rates have improved since its recovery plan was put in place. The company also expanded its field teams and reduced emergency service times, though regulators stressed that results still need validation during peak storm periods.
Aneel’s chair endorsed Da Costa’s position but said he could revisit it once Nogueira presents his own vote. Director Willamy Frota backed the rapporteur as well. Under Aneel rules, Nogueira has 60 days to return the case to the agenda.
